{"id":8026,"date":"2022-03-04T13:29:37","date_gmt":"2022-03-04T11:29:37","guid":{"rendered":"https:\/\/ceccarbistrita.ro\/ro\/?p=8026"},"modified":"2022-03-04T13:29:39","modified_gmt":"2022-03-04T11:29:39","slug":"noi-reglementari-privind-obligatia-intreprinderilor-din-domeniul-transporturilor-de-a-si-demonstra-capacitatea-financiara-cu-ajutorul-expertului-contabil","status":"publish","type":"post","link":"https:\/\/ceccarbistrita.ro\/ro\/noi-reglementari-privind-obligatia-intreprinderilor-din-domeniul-transporturilor-de-a-si-demonstra-capacitatea-financiara-cu-ajutorul-expertului-contabil\/","title":{"rendered":"Noi reglement\u0103ri privind obliga\u021bia \u00eentreprinderilor din domeniul transporturilor de a-\u0219i demonstra capacitatea financiar\u0103, cu ajutorul expertului contabil"},"content":{"rendered":"<section   class=\"fw-main-row  auto  fw-section-position-back\"    >\n\t\t\t<div class=\"fw-container\" >\n\t\t<div class=\"fw-row\">\n\t<div id=\"column-69e058a8cad65\" class=\"fw-col-sm-8 tf-sh-a2e61b64de9b50969e9dfc59128f0ff5\" >\n\t<div class=\"fw-wrap-col-inner clearfix  \"   >\n\t\t\t\t<div class=\"fw-col-inner\">\n\t\t\t<div class=\"fw-text-box tf-sh-30d0c67fc7cff86f854190ea4114ff0a \" >\n\t<div class=\"fw-text-inner\">\n\t\t<p><span class=\"stk-highlight\">Legisla\u021bia \u00een domeniul transporturilor rutiere a cunoscut recent o serie de modific\u0103ri ca urmare a necesit\u0103\u021bii asigur\u0103rii cadrului legal de implementare pentru noile reglement\u0103ri ale Uniunii Europene cuprinse \u00een pachetul Mobilitate I, care se aplic\u0103 \u00eencep\u00e2nd cu luna februarie a acestui an.<\/span><\/p>\n<p><span class=\"stk-highlight\">Astfel, prin<\/span>\u00a0<em><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/251255\" target=\"_blank\" rel=\"noreferrer noopener\">OG nr. 12\/2022<\/a>\u00a0<\/em><span class=\"stk-highlight\"><em>pentru pentru modificarea \u015fi completarea unor acte normative din domeniul transporturilor rutiere (<\/em>publicat\u0103 \u00een Monitorul Oficial nr. 98\/31.01.2022)<em>\u00a0a fost modificat\u0103, \u00eentre altele,\u00a0<\/em><\/span><em><a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/131203\">OG nr. 27\/2011<\/a>\u00a0<\/em><span class=\"stk-highlight\"><em>privind transporturile rutiere<\/em>, care include o serie de prevederi referitoare la\u00a0<strong>demonstrarea, de c\u0103tre \u00eentreprindere, a capacit\u0103\u021bii financiare pe baza conturilor anuale certificate de anumite categorii de speciali\u0219ti, inclusiv de exper\u021bii contabili.<\/strong><\/span><\/p>\n<p><span class=\"stk-highlight\">A\u0219adar, principalele amendamente aduse prin OG nr. 12\/2022 vizeaz\u0103 modificarea art. 15 al OG nr. 27\/2011, referitor la condi\u021biile pe care o \u00eentreprindere trebuie s\u0103 le \u00eendeplineasc\u0103\u00a0\u00een vederea respect\u0103rii cerin\u021bei privind capacitatea financiar\u0103. Astfel, potrivit noului act normativ, aceste condi\u021bii sunt urm\u0103toarele:\u00a0<strong>a)<\/strong>\u00a0s\u0103 demonstreze, pe baza conturilor anuale certificate de un auditor financiar\/<strong>expert independent<\/strong>, c\u0103 dispune \u00een fiecare an de capital \u0219i rezerve \u00een valoare total\u0103 de cel pu\u021bin 9.000 euro, pentru primul autovehicul utilizat, de 5.000 euro pentru fiecare autovehicul suplimentar sau combina\u021bie suplimentar\u0103 de vehicule utilizat(\u0103) cu o mas\u0103 maxim\u0103 autorizat\u0103 care dep\u0103\u0219e\u0219te 3,5 tone \u0219i de 900 euro pentru fiecare autovehicul suplimentar sau combina\u021bie suplimentar\u0103 de vehicule utilizat(\u0103), cu o mas\u0103 maxim\u0103 autorizat\u0103 care dep\u0103\u0219e\u0219te 2,5 tone, dar nu dep\u0103\u0219e\u0219te 3,5 tone;\u00a0<strong>b)<\/strong>\u00a0s\u0103 demonstreze, pe baza conturilor anuale certificate de un auditor financiar\/<strong>expert independent<\/strong>, c\u0103 dispune \u00een fiecare an de capital \u0219i rezerve \u00een valoare total\u0103 de cel pu\u021bin 1.800 euro pentru primul vehicul utilizat \u0219i de 900 euro pentru fiecare vehicul suplimentar utilizat, \u00een cazul \u00eentreprinderilor care exercit\u0103 ocupa\u021bia de operator de transport rutier de m\u0103rfuri numai cu ajutorul unor autovehicule sau combina\u021bii de vehicule a c\u0103ror mas\u0103 maxim\u0103 autorizat\u0103 dep\u0103\u0219e\u0219te 2,5 tone, dar nu dep\u0103\u0219e\u0219te 3,5 tone;\u00a0<strong>c)<\/strong>\u00a0\u00eentreprinderea \u0219i\/sau managerul de transport al acesteia s\u0103 nu fie \u00een stare de faliment, \u00een situa\u021bie de insolven\u021b\u0103 f\u0103r\u0103 a avea un plan de reorganizare aprobat, \u00een stare de dizolvare sau de lichidare, potrivit legii.<\/span><\/p>\n<p><em><span class=\"stk-highlight\">Denumirea de\u00a0<strong>expert independent\u00a0<\/strong>se refer\u0103 inclusiv la\u00a0<strong>expertul contabil<\/strong>, care este inclus \u00een categoriile de speciali\u0219ti care se pot implica pentru a sprijini \u00eentreprinderile din domeniul transporturilor s\u0103-\u0219i demonstreze capacitatea financiar\u0103.<\/span><\/em><\/p>\n<p><span class=\"stk-highlight\">\u00cen esen\u021b\u0103, prin modificarea OG nr. 27\/2011 se stabilesc urm\u0103toarele:\u00a0<img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/13.0.1\/svg\/25aa.svg\" alt=\"\u25aa\" \/>\u00a0actualizarea condi\u021biilor care trebuie \u00eendeplinite de c\u0103tre o \u00eentreprindere pentru respectarea cerin\u021belor de sediu real \u0219i stabil, de competen\u021b\u0103 profesional\u0103, de bun\u0103 reputa\u021bie \u0219i de capacitate financiar\u0103, \u00een vederea ob\u021binerii accesului la ocupa\u021bia de operator de transport rutier;\u00a0<img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/13.0.1\/svg\/25aa.svg\" alt=\"\u25aa\" \/>\u00a0extinderea domeniului de aplicare a prevederilor ordonan\u021bei \u0219i la \u00eentreprinderile de transport rutier contra cost de m\u0103rfuri care desf\u0103\u0219oar\u0103 opera\u021biuni de transport na\u021bional \u0219i\/sau interna\u021bional numai cu ajutorul unor autovehicule sau combina\u021bii de vehicule a c\u0103ror mas\u0103 maxim\u0103 autorizat\u0103 dep\u0103\u0219e\u0219te 2,5 tone \u0219i nu dep\u0103\u0219e\u0219te 3,5 tone, \u00eencep\u00e2nd cu data de 21 mai 2022;\u00a0<img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/13.0.1\/svg\/25aa.svg\" alt=\"\u25aa\" \/>\u00a0actualizarea prevederilor privind efectuarea opera\u021biunilor de transport rutier de m\u0103rfuri contra cost \u00een regim de cabotaj, \u00een conformitate cu art. 8 din Regulamentul (CE) nr. 1.072\/2009, astfel cum a fost modificat prin Regulamentul UE 1055\/2020;\u00a0<img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/13.0.1\/svg\/25aa.svg\" alt=\"\u25aa\" \/>\u00a0introducerea temeiului juridic pentru stabilirea, prin hot\u0103r\u00e2re a Guvernului, a m\u0103surilor de aplicare a dispozi\u021biilor privind deta\u0219area conduc\u0103torilor auto, prev\u0103zute \u00een Anexa nr. 31, Partea A la Sec\u021biunea 2 din Acordul comercial \u0219i de cooperare \u00eentre Uniunea European\u0103 \u0219i Comunitatea European\u0103 a Energiei Atomice, pe de o parte, \u0219i Regatul Unit al Marii Britanii \u0219i Irlandei de Nord, pe de alt\u0103 parte (Acordul UE-UK), \u00eenc\u0103lc\u0103rile cu caracter contraven\u021bional ale acestor dispozi\u021bii, precum \u0219i sanc\u021biunile contraven\u021bionale aplicabile \u00een cazul constat\u0103rii \u00eenc\u0103lc\u0103rilor;\u00a0<img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/13.0.1\/svg\/25aa.svg\" alt=\"\u25aa\" \/>\u00a0stabilirea faptului c\u0103 \u00eenc\u0103lc\u0103rile prevederilor Regulamentului (CE) nr. 1.071\/2009, ale Regulamentului (CE) nr. 1.072\/2009 \u015fi ale Regulamentului (CE) nr. 1.073\/2009, ale OG 27\/2011, precum \u015fi ale normelor de aplicare a acesteia, cu caracter contraven\u021bional, se clasific\u0103 \u00een 4 categorii, \u00een conformitate cu prevederile Regulamentului UE 2016\/403 de completare a Regulamentului (CE) nr. 1071\/2009 al Parlamentului European \u0219i al Consiliului \u00een ceea ce prive\u0219te clasificarea \u00eenc\u0103lc\u0103rilor grave ale normelor Uniunii, care pot determina pierderea de c\u0103tre un operator de transport rutier a bunei reputa\u021bii \u0219i de modificare a anexei III la Directiva 2006\/22\/CE a Parlamentului European \u0219i a Consiliului, dup\u0103 cum urmeaz\u0103: a) cele mai grave \u00eenc\u0103lc\u0103ri b) \u00eenc\u0103lc\u0103ri foarte grave; c) \u00eenc\u0103lc\u0103ri grave; d) \u00eenc\u0103lc\u0103ri minore \u2013 normele metodologice prev\u0103zute la art. 90 se actualizeaz\u0103 \u00een termen de 90 de zile de la data intr\u0103rii \u00een vigoare a prezentei ordonan\u021be \u0219i se aprob\u0103 prin ordin al ministrului transporturilor \u0219i infrastructurii, care se public\u0103 \u00een Monitorul Oficial al Rom\u00e2niei, Partea I;\u00a0<img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/13.0.1\/svg\/25aa.svg\" alt=\"\u25aa\" \/>\u00a0\u00een 30 de zile de la intrarea \u00een vigoare a prezentei ordonan\u021be, I.S.C.T.R. elaboreaz\u0103 procedura administrativ\u0103 privind pierderea bunei reputa\u021bii a \u00eentreprinderii\/managerului de transport, prev\u0103zut\u0103 la art. 6 alin.
